Terms of Service

These terms cover your use of Bardfolk. By creating an account, you agree to them.

The service

Bardfolk is a private home for writing and keeping songs and poems. It's an early-stage product and evolves often; features may change.

Who we are

Bardfolk is operated by Limelight Digital LLC, a Utah limited liability company ("Bardfolk," "we," "us"). These terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules, and any dispute that isn't resolved informally will be handled by the state or federal courts located in Utah. Nothing here takes away mandatory consumer protections you may have under the laws of your home country.

Your account

You're responsible for your account and for keeping your sign-in secure. Use a real email so you can recover access. One person per account. You must be at least 13 to use Bardfolk (or older where your country requires); by creating an account, you confirm you meet that age.

Your content stays yours

You own everything you create on Bardfolk. You grant us only the limited, non-exclusive, royalty-free permission needed to run the service: to host, store, back up, reproduce, transmit, display, and make incidental technical changes (like thumbnails or format and audio conversions) to your content, solely to operate Bardfolk and show your content to you and to anyone you choose to share with, including through our service providers. We claim no ownership of your work, and we will never sell it or use it to train AI models.

What’s welcome, and what isn’t

Bardfolk is built to feel safe. Most of what you make is private, and you decide what anyone else sees. To keep it that way, you agree not to:

  • Upload content you don't have the rights to;
  • Post anything unlawful, or anything hateful, harassing, threatening, sexually exploitative, or otherwise objectionable;
  • Harass, abuse, threaten, or impersonate anyone;
  • Try to reach other people's private content, scrape the service, reverse-engineer it, or work around our security and access controls;
  • Disrupt Bardfolk or the people using it.

We don't tolerate objectionable content or abusive behavior. If you run into either, you can report content or block another person from within Bardfolk, or reach us at bardfolk.official@gmail.com. We review reports and may remove content and suspend or remove accounts that break these rules, and we aim to act quickly.

Sharing

Friend connections, public profiles, and share links are entirely your choice. When you make something public or share a link, you're responsible for what you've chosen to share.

Collaboration

You can invite friends to collaborate on a song. A collaborator can edit that song's words, chords, recordings, and details, but the song stays yours: collaborating grants editing access, not ownership, and transfers no rights in your work. You can remove a collaborator or delete the song at any time; removing access takes effect immediately, though edits a collaborator already made remain part of the song. If you collaborate on someone else's song, you grant them permission to keep and use your contributions to that song, and you gain no ownership of it. If you later delete your account, content in your own songs is removed, but contributions you made to another person's song may remain part of that song, since the owner relies on them. Only edit content you have the right to contribute.

Copyright and takedown

Bardfolk is a home for your songs: words and recordings you have the right to keep here. We respect songwriters, and that includes the songwriters whose work you might cover or quote. Don't upload anything you don't have the rights to, and if someone uploads something of yours, we'll help make it right.

If you believe content on Bardfolk infringes your copyright, send a notice to our designated agent at bardfolk.official@gmail.com (or by mail to the address below). To be valid under the Digital Millennium Copyright Act, your notice must include:

  • A physical or electronic signature of the copyright owner or someone authorized to act for them;
  • Identification of the copyrighted work you say has been infringed;
  • Identification of the material on Bardfolk you want removed, with enough detail for us to find it (such as a link);
  • Your name, address, telephone number, and email;
  • A statement that you have a good-faith belief the use isn't authorized by the copyright owner, its agent, or the law; and
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

When we receive a valid notice, we'll remove or disable access to the material and let the person who posted it know.

If your content was removed and you believe that was a mistake (for example, you hold the rights or the use is permitted), you can send a counter-notice to the same address including:

  • Your signature;
  • Identification of the material that was removed and where it appeared before removal;
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification; and
  • Your name, address, and telephone number, plus a statement that you consent to the jurisdiction of the federal court for your district (or, if you're outside the US, the district where Limelight Digital LLC is located) and that you'll accept service of process from the person who filed the original notice.

If we receive a valid counter-notice, we may restore the material in 10 to 14 business days unless the original complainant files a court action.

Repeat infringers. We will, in appropriate circumstances, suspend or terminate the accounts of people who repeatedly infringe others' copyrights.

Payments

Bardfolk is free to use, with an optional paid membership, Bardfolk Pro, that unlocks additional storage and features. Pro is offered as a monthly or annual subscription; the current price and billing period are shown before you buy and at checkout, and any applicable taxes may be added. Payments are processed by our payment provider, Stripe.

Your subscription renews automatically at the end of each billing period, at the then-current price, until you cancel. You can cancel anytime from the Bardfolk Pro section of your account. When you cancel, your Pro features stay active through the end of the period you've already paid for, and you won't be charged again.

Except where the law requires otherwise, payments are non-refundable, and we don't give refunds or credits for partial billing periods or for time that has already passed. If you believe you were charged by mistake, contact us at bardfolk.official@gmail.com and we'll make it right. If we change subscription prices, we'll give you advance notice before the new price applies to you.

Anything you purchase through the Apple App Store or Google Play is also subject to those stores' own payment and refund policies.

If you’re using Bardfolk from the App Store

A few extra terms apply when you download Bardfolk from Apple's App Store, because Apple asks every app to include them:

  1. These terms are between you and Limelight Digital LLC only, not with Apple, and Apple isn't responsible for Bardfolk or its content.
  2. Apple has no obligation to provide maintenance or support for Bardfolk.
  3. If Bardfolk fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for Bardfolk.
  4. Apple isn't responsible for addressing any claims you or a third party have relating to Bardfolk, including product-liability, legal-compliance, and consumer-protection or privacy claims.
  5. If a third party claims Bardfolk infringes their intellectual property, Limelight Digital LLC, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.
  6. You confirm you aren't located in a country subject to a US Government embargo or designated as "terrorist-supporting," and that you aren't on any US Government list of prohibited or restricted parties.
  7. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Ending your use

You can delete your account at any time from your Account settings. We may suspend or remove accounts that violate these terms or put the service or others at risk.

Disclaimers

Bardfolk is provided "as is," without warranties of any kind, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where those disclaimers aren't allowed by law. We work hard to keep your content safe, but we can't guarantee uninterrupted service or that data will never be lost; please keep your own copies using the Backup section of your Account.

Limitation of liability

To the fullest extent permitted by law, Bardfolk and Limelight Digital LLC won't be liable for indirect, incidental, special, or consequential damages, or for lost data or profits, arising from your use of the service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US $100. Some places don't allow certain limitations, so parts of this may not apply to you, and nothing here limits liability that can't be limited by law.

Your responsibility for your content

You're responsible for the content you upload and share. To the fullest extent permitted by law, you agree to indemnify and hold harmless Limelight Digital LLC and the people who run it from claims, damages, and costs (including reasonable legal fees) arising out of content you upload or share, your use of Bardfolk, or your violation of these terms or someone else's rights.

Changes

We may update these terms as the product grows; the date above reflects the latest version. For significant changes, we'll give reasonable advance notice, by email or an in-app notice, before they take effect. Continued use after that means you accept the changes.

General

If any part of these terms is found unenforceable, the rest still applies. These terms are the entire agreement between you and us about Bardfolk. We may transfer these terms to another company (for example, in a merger or sale of the business); you may not transfer your account or these terms without our permission. If we don't enforce a right right away, that's not a waiver of it. And neither of us is responsible for delays or failures caused by events outside our reasonable control.
